Recently the Beijing 1st Intermediate People's Court formally accepted the case in which Henan Shuaike Pharmaceutical Co. Ltd. sued Warner Health Products Inc., an American pharmaceutical company, for trademark infringement. A trial on the case will be held soon.
In 1996, Henan Shuaike registered the trademark "帅克" in China, covering several series of antibiotic drugs and drugs for cardiovascular and cerebrovascular diseases. According to Henan Shuaike, in 2003, the American pharmaceutical company entrusted a Chinese company to sell its "帅克胶囊 Shark Capsule" which was claimed to be a good cure.
Henan Shuaike stated that the defendant had infringed its registered trademark "帅克" by using the words "帅克胶囊" on its products. The plaintiff requested that the defendant should stop the infringement and make compensation.
