What is new plant species in law?

The concept of new plant species in law is different from that in natural science. It is a concept derived from the comparison of known and existing plant species in accordance with certain legal conditions. Both the meaning of "plant species" and the requirement of "new" are included.

New: According to the current UPOV Convention, "new" should be defined by whether the estoppel of a certain plant species or related materials have been sold with the permission of the right holder.

Plant species: In the botanical classification from high to low, it is divided into seven categories: kingdom, phylum, class, order, family, genus and species. "Plant species" is the concept below "species".
