Montagut sues two companies in Shanghai for trademark infringement

Recently French Bonneterie Cevenole SARL instituted a proceeding before the Shanghai 2nd Intermediate People's Court against French Mengtejiao Laundry International Group Co.(registered in Hong Kong) and Shanghai Mengjiao Investment Management Co. Ltd. for trademark infringement and unfair competition. The plaintiff requested the two defendants to stop the infringement and compensate 500,000 RMB yuan.
Bonneterie Cevenole SARL, established in 1956, has registered the trademark "MONTAGUT," "梦特娇" and the figurative mark of a flower in China. With years of advertising, the series of trademarks enjoy a good reputation. In March and April 2006, Montagut was twice identified as "Well-known Trademark" the Beijing Higher People's Court and the Changsha Intermediate People's Court in Hunan Province.
According to the plaintiff, Shanghai Mengjiao used the trademark representations of Montagut and the flower device on its website, brochures and tablet without any authorization. It also infringed the plaintiff's "Well-known Trademark" by using "梦特娇" in its trade name, which may confuse the consumers and constituted unfair competition.
Therefore, the plaintiff requested the court to order that the two defendants should stop the infringement and jointly compensate 500,000 RMB yuan.
