National Association of Realtors (NAR) Pays $52.25 Million to Settle Tuccori Antitrust Class Action

On April 10, 2026, local time, the National Association of Realtors (NAR) announced that it had reached a settlement agreement, agreeing to pay $52.25 million to resolve the antitrust class action lawsuit filed by homebuyer James Tuccori through a "voluntary opt-in" approach. NAR was not a defendant in the case, but proactively joined the primary settlement framework in order to comprehensively resolve related claims.

The Tuccori case alleged that multiple real estate brokerage firms conspired through industry rules to inflate transaction commissions. This NAR settlement covers NAR itself, its state and local associations, Multiple Listing Services (MLS), and other related entities, with the scope of protection said to be "broader than any prior settlement." The settlement agreement requires NAR to continue complying with the reform rules already implemented in the Sitzer/Burnett home seller litigation (settled for $418 million) from March 2024, imposes no new business practice modifications, and merely requires NAR to fund the settlement fund over several years in installments.

In addition, NAR will seek a stay from the court in another homebuyer commission case, Batton (in which NAR is a defendant), because the Tuccori settlement is intended to release the overlapping claims in that case. The agreement is currently pending court approval. NAR stated that this move will reduce legal uncertainty in the industry and stabilize the market compliance environment.
